Legal Framework: The Dutch Gambling Act

Gambling in the Netherlands is regulated by the Wet op de kansspelen (Gambling Act), originally enacted in 1964. This law establishes the legal basis for all forms of gambling in the country and has been amended several times to keep pace with technological and social changes.

The Gambling Act distinguishes between several categories of games of chance: casino games, lotteries, sports betting, and online gambling. Each category has its own licensing requirements and regulatory framework. The overarching principle of Dutch gambling regulation is that gambling is prohibited unless specifically authorized by the government through a licence.

In October 2021, the Remote Gambling Act (Wet kansspelen op afstand) came into force, significantly modernising the legal framework by introducing a licensing system for online gambling operators. This was a landmark change that brought the Netherlands in line with other EU countries that had already regulated online gambling.

The government's stated goals for gambling regulation include preventing gambling addiction, protecting consumers, combating fraud and money laundering, and ensuring that gambling remains a form of entertainment rather than a source of social harm.

Holland Casino: The State-Licensed Monopoly

Holland Casino has held the exclusive licence to operate land-based casinos in the Netherlands since 1976. Originally a fully state-owned enterprise, the company was partially privatised in recent years, though the Dutch government retains significant oversight. Holland Casino currently operates 14 venues spread across eight Dutch cities.

The monopoly model was chosen deliberately by the Dutch government to maintain tight control over casino gambling. By channelling all land-based casino activity through a single licensed operator, the authorities can more effectively enforce responsible gambling measures, prevent criminal infiltration, and ensure consistent standards across all venues.

Holland Casino venues range from the grand Scheveningen location inside the historic Kurhaus hotel to more intimate venues in cities like Breda and Venlo. Despite being a single operator, each casino has its own character and atmosphere, influenced by its city and clientele. The company employs approximately 4,000 people and welcomes over 6 million visitors annually.

Online Gambling Regulation (KSA)

The Kansspelautoriteit (KSA) is the independent regulatory body responsible for supervising all gambling activities in the Netherlands. Established in 2012, the KSA replaced the earlier Gaming Board (College van toezicht op de kansspelen) and has broader enforcement powers.

Since the Remote Gambling Act took effect in October 2021, the KSA has issued licences to a select number of online gambling operators. These licensed operators must comply with strict regulations regarding player protection, responsible gambling tools, advertising restrictions, and data privacy. Only operators holding a valid KSA licence are legally permitted to offer online gambling services to Dutch residents.

The KSA actively pursues unlicensed operators targeting Dutch players, using measures ranging from warning letters to ISP blocking and financial penalties. Players are advised to gamble only on KSA-licensed platforms to ensure their rights are protected and their funds are secure.

Key requirements for licensed online operators include offering mandatory deposit limits, loss limits, and time-out options; displaying responsible gambling messages; verifying player identity and age; and contributing to the Central Register of Exclusion from Gambling (CRUKS).

Age Requirements

The minimum gambling age in the Netherlands is 18 years old. This applies to all forms of gambling: casino visits, online gambling, lotteries, and sports betting. There are no exceptions.

At Holland Casino venues, every visitor must present a valid identity document at the entrance. Accepted documents include a passport, EU identity card, or Dutch driving licence. The ID check is strict and consistently enforced — visitors without valid identification will not be admitted, regardless of appearance.

For online gambling, operators are required to verify the age and identity of all players through a robust Know Your Customer (KYC) process before allowing any real-money play.

Tax on Gambling Winnings

In the Netherlands, gambling winnings above €449 are subject to a 29.5% tax (known as kansspelbelasting, gambling tax). This applies to both Dutch residents and tourists gambling in the country.

For Holland Casino and other land-based venues, the tax is automatically deducted before the winnings are paid out. This means you receive the net amount — you do not need to declare or pay the tax yourself. The casino handles the withholding and payment to the Belastingdienst (Dutch Tax Authority).

For online gambling, the process is similar: licensed operators deduct the tax before crediting winnings to your account. For lotteries, the tax is applied to prizes above the threshold.

Losses cannot be offset against winnings for tax purposes. The tax is calculated per game session, not annually.

History of Gambling in the Netherlands

The Netherlands has a rich gambling history stretching back centuries. Lotteries were used to raise funds for public works as early as the 15th century, and the Dutch were instrumental in developing many of the financial instruments that evolved from gambling practices.

The modern era of Dutch gambling began with the 1964 Gambling Act, which established the legal framework still in use today (though much amended). Holland Casino was founded in 1976, opening its first venue in Zandvoort and gradually expanding to its current network of 14 locations.

The turn of the millennium brought challenges as online gambling grew without regulation. For nearly two decades, the Dutch government debated how to handle internet gambling, with various proposals stalling in parliament. Finally, in 2019, the Senate approved the Remote Gambling Act, which took effect in October 2021.

The privatisation of Holland Casino, first proposed in the 2010s, remains an ongoing process. The government has signalled its intention to sell a majority stake while maintaining regulatory oversight to ensure responsible operations continue.
